Digital Assets transactions (such as transactions conducted via the Cutoshi Swap) entail significant risks of financial loss. You should not use Digital Assets or engage in transactions that you are not prepared to lose entirely.
This Risk Disclosure Statement discusses the principal risks of transactions with Digital Assets on Cutoshi Swap, but it does not and cannot describe every risk or consideration involved in holding, trading, buying, or engaging in other Digital Assets transactions. This Risk Disclosure Statement forms a part of, and utilizes certain terms defined in, the Terms of Use for Cutoshi Swap.
1. High Price Volatility
The value of Digital Assets is entirely driven by market forces of supply and demand, and they tend to be much more volatile than traditional fiat currencies and commodities. The price of Digital Assets can fluctuate wildly and can result in significant gains or losses in a very short period of time.
2. Legal Risk
The legality of Digital Assets, as well as the trading or possession of them, may not be clear and may vary depending on the jurisdiction in which you reside. This means that the legality of engaging in Digital Assets transactions is not always clear. Whether and on what basis a Digital Asset may constitute property, an asset, or a right could vary from one jurisdiction to another. You are solely responsible for understanding the laws that apply to you and your property, rights, or assets and how they relate to Digital Assets.
3. Limited Supervision
Most Digital Assets markets are not regulated or supervised by any relevant authorities. There is no centralized authority or entity that can intervene to protect the value of a Digital Asset or adjust its supply in times of crisis.
4. Irreversible Transactions
Due to the decentralized nature of Digital Assets, transactions are typically irreversible. This means that once a transaction is confirmed, it cannot be undone, and any losses due to fraudulent or accidental transactions may not be recoverable. Cutoshi Swap will only process transactions that are initiated through the website or platform and to the designated address entered during the transaction. We are not responsible for accidental transactions, including but not limited to sending funds to incorrect or inactive addresses. However, we will make every possible effort to assist in tracking and recovering such assets within a period of six (6) months from the date of the transaction. All fees incurred for return transactions will be borne by the user.
5. The Blockchains on Which Digital Assets Operate May Temporarily or Permanently Fork
Some blockchain networks are powered by open-source software. When a change is made to the software, and there is less than a substantial majority of the network agreeing to it, the blockchain could split, resulting in a "fork." This may cause two separate chains to operate, with each maintaining its own version of the asset. Cutoshi Swap is not responsible for tracking, storing, or transferring any "split" Digital Assets created due to such forks. We will, however, make reasonable efforts to assist in tracking such Digital Assets within six (6) months from the date of the fork, should it be technically possible to recover them.
6. Dependence on Internet Connectivity
Digital Assets transactions are executed using internet-based software. There are inherent risks in using internet-dependent systems, including potential failures in hardware, software, or internet connection. Cutoshi Swap takes steps to ensure secure transactions, but we do not control the signal power, reception, or reliability of your internet connection. Any failure in connectivity could prevent a transaction from being executed as intended or at all.
7. Unanticipated Risks
Digital Assets and blockchain technology are relatively new and evolving. In addition to the risks mentioned above, there may be other unanticipated risks associated with the acquisition, storage, transfer, or use of Digital Assets. These risks may include unforeseen variations or combinations of the risks already mentioned, and may materialize over time as technology or markets evolve.
By using Cutoshi Swap, you acknowledge that you fully understand the risks associated with the transactions and services, and that you are using them at your own risk. Always ensure that you are aware of the risks involved and never trade more than you are willing to lose.
